1. Extent of Validity
The following General Terms and Conditions of Business shall apply to any business relation between jonas-care and the buyer in the version valid at the time when the order is placed.

Any differing conditions will not be accepted by jonas-care unless jonas-care has agreed to their validity in writing.

2. Conclusion of the Contract
At all times the offers are subject to alterations and non-binding unless they have not been confirmed expressively in writing by jonas-care in form of a binding offer. Buyer orders become binding only after written confirmation or upon delivery of the goods accompanied by an invoice.

3. Shipment and Delivery
jonas-care will make all efforts to keep the indicated delivery dates, however they are not binding. As a rule delivery will be made 2 – 3 work days after receipt of order. Unless otherwise specified shipment will be made on cost and risk of the buyer. Mode of dispatch and parcel delivery service are determined by jonas-care. Should any delay in delivery occur the buyer will be informed by e-mail or fax giving an approximate delivery date respectively an alternative offer.

Delivery within Germany:
current lump sum for shipping costs is given in the shop (see “orders”)

Delivery to EU countries:
current lump sum for shipping costs is given in the shop (see “orders”)

Delivery to non-EU countries:
lump sum for shipping depends on country of destination and is determined prior to the order. The buyer himself is responsible for all clearing formalities.

4. Retention of Title
The goods remain jonas-care’s property until the complete invoice amount is settled.

5. Prices, Due Date and Payment
Unless stipulated otherwise, the end user will be invoiced the price valid on the day when the order is placed. Prices given are final prices including statutory value-added tax. Shipments outside the European Union will be invoiced without tax. Invoices are due for payment immediately without any deduction unless no other due date is indicated on the invoice. 

Payment is considered effected only if the complete invoice amount has been credited to jonas-care’s account.

Ways of payment:

Cash on delivery (only within Germany or companies / institutions):
The buyer pays on receipt of the goods including costs for shipping and packaging. 

Advance Payment (within and outside Germany):
The buyer pays to the account of jonas-care in advance. Any bank charges have to be borne by the buyer in order to assure that the full invoice amount is credited to jonas-care’s account.

Credit Card
Payment by credit card is not possible.

6. Warranty
The buyer is incumbent on examination and inspection of the goods. jonas-care is not liable for any losses arising from goods which have been passed on without examination. The seller is also not liable for the applicability of the goods for which purpose the buyer intended to use the product. Furthermore jonas-care disclaims liability for losses which might arise from the processing and the use of the goods. The delivered articles are pre-mounted for transportation.

In legally-allowed cases jonas-care limits liability to the product itself and is therefore not liable for damages which do not arise on the product itself; especially jonas-care is not liable for lost profit or any other financial loss of the buyer. Furthermore any damages arising from non-observance of the safety and caution instructions are excluded from liability.

7. Right of Return
The buyer has the right to cancel the sales contract within 14 days from receipt of the goods if he returns the goods to jonas-care undamaged in the original packing. The parcel has to be shipped at the buyers expense. Return shipments sent freight forward will not be accepted. The right of return is exercised by sending back the goods in due-date time. There will be no refund for the shipping costs when returning the goods. The sales contract is cancelled provided that the return shipment is originally packed, undamaged and complete. The invoice amount is credited to the buyer’s account within 30 days. Any goods individually manufactured for the buyer are excluded from the right of return.

8. Effectiveness of the Contract
If one or several provisions in these General Terms and Conditions of Business become invalid the remainder of this contract will be unaffected. The contracting parties will replace an invalid provision with a legally valid one that as closely as possible matches the invalid provision.

9. Applicable Law
For all business relations only the law of the Federal Republic of Germany will be applicable.

10. Place of Jurisdiction
Sole applicable law for the legal relationship is the laws of the Federal Republic of Germany without recourse to UN commercial law Place of jurisdiction and fulfilment is D-73430 Aalen / Germany.
